EPA investigating roofing work at Yorkville chapel

YORKVILLE — The good news for the Chapel on the Green is that is has a new roof.

The bad news is that the contractor who removed the old roof has been cited by the Illinois Environmental Protection Agency for improper handling and management of asbestos in removing the material.

The IEPA Tuesday announced it is asking the Illinois attorney general to proceed with enforcement against Advanced Roofing, Inc., 311 E. Van Emmon St. here, for the way it removed and disposed of old shingles from the historic church. An IEPA inspector at the site of the work done last week determined that the roof material did have asbestos fibers in it.

The inspector also said Advanced Roofing workers were transporting asbestos-laden material at the site in open wheelbarrows, and were dumping the material in unlined trash bins.

“There were pieces more or less tossed on the ground that were walked on or driven over, releasing the asbestos fibers, which is where the danger is,” said Maggie Carson, of the IEPA. “Asbestos has to be handled in certain ways.”

Carson said the IEPA referred the case to the attorney general because the IEPA has no enforcement authority. In Illinois, the law is set up so the attorney general’s office is the enforcement arm of the environmental agency.

The IEPA can assist and advise the Attorney General’s office, but the top legal office in the state will determine whether to seek fines and/or penalties against Advanced Roofing or the Chapel on the Green, or both.

One of the remedies the IEPA is seeking is to force the chapel, which is operated by a not-for-profit organization, to retain a licensed asbestos abatement contractor to put in work methods and procedures for asbestos remediation. But Fred Dickson, the Aurora attorney who is president of the Chapel on the Green organization, said the work is finished and the new roof is in place.

Also, Carson did say the chapel had hired a design firm, so that part of the remedy may have been complied with.

Dickson said the attorney general’s office could confine its enforcement to Advanced Roofing, although it could bring in the chapel and “maybe make us spend some money.”

Dickson said he was at the site June 6 when the work was being done, at the same time the IEPA inspector was at the site, responding to a complaint that was made.
