Man fined $1000 for use of laser pointer

A 21 year-old man pleaded guilty in municipal court last week to pointing a laser at a U.S. Coast Guard helicopter off the Boardwalk.

Meanwhile, City Council will introduce an ordinance banning the sale of the potentially dangerous laser instruments at a Thursday, June 23 meeting.

According to Capt. Steve Ang of the Ocean City Police Department, Eric J. Bouda of Mantua purchased a $30 laser pointer on the Boardwalk and directed it at the helicopter. Bouda was fined $1,000 and received 15 days of community service for interference with transportation. If he successfully completes the community service component, the fine could be reduced to $500. Bouda still faces civil penalties from the Federal Aviation Administration.

On Tuesday, June 7, Coast Guard officials notified the OCPD that someone on the Boardwalk pointed a laser beam at a pilot, temporarily blinding him. The Coast Guard was able to pinpoint the location of the laser beam and police apprehended Bouda shortly thereafter.

Ang says the problem will continue as long as Boardwalk merchants continue to sell the potentially dangerous laser pointers to a willing public. Merchants have been asked not to sell the devices, but not all have complied.

“It becomes a city ordinance, stores will not be able to sell them,” said Ang. “It’s wonderful that the city administration is taking steps and it’s a step in the right direction but we need more. We need it to become a crime to possess a laser pointer.”

Ang said he conferred with Mayor Jay Gillian, Business Administrator Mike Datillo and City Solicitor Dorothy McCrosson last week about the issue. Coast Guard and Spirit Airlines pilots have complained about the use of laser pointers, Ang said.

“Pilots are telling us that flying off the Ocean City Boardwalk is like a laser show,” Ang said. “This is the second year in a row we’ve had problems. With the most recent incident, it’s reached a point where we have to do something. There are some serious penalties involved, but once again, we are dealing with after-the-fact. We would prefer that people can’t buy them to begin with.”

In 2009, the FAA reported 1,500 laser incidents. In 2010, more than 2,800 were reported.

The FAA is trying to impose steeper civil penalties, including a fine of up to $11,000 on perpetrators in an effort to stop the behavior, said Ang.
